Case Management Directions

It is recorded that:
1. This Order is made after considering the Order dated 26th November 2024 and non-compliance with that Order and previous Orders to file a response and a case management questionnaire. The Appellant appears to have abandoned his appeal as noted by the lack of response.
2. An appeal hearing had been scheduled for 9th January 2025.
3. Noting the terms of the Order dated 26th November 2024 that:
If a Case Management Questionnaire is not filed in accordance with paragraph 4 by the APPELLANT, the appeal will be automatically struck out, without any further hearing and paragraphs 6-8 of this Order will be discharged.
It is ORDERED THAT:
4. This Order confirms that the appeal has been struck out for failure to comply with the case management directions from the Tribunal.
5. Any application to reinstate must be made within five working days of receipt of this Order and contain both a reply to the Respondent’s response (if relied upon) and a completed case management questionnaire.
6. The hearing on 9th January 2025 is vacated.
Reasons:
The Appellant has not filed a CMQ but had indicated that they want a hearing on the appeal form. That hearing had been set up. The Appellant has not been in contact with the Tribunal since filing the appeal including to comply with mandatory directions. The “unless order” made it clear that the consequences of non-compliance would be that the appeal is struck out.
Tribunal hearing time is a valuable resource and will not be allocated if an Appellant has effectively abandoned their appeal.
