Who we are

Find Case Law is managed by The National Archives, a non-ministerial government department that is the official archive and publisher for the UK Government and for England and Wales.

The National Archives is the data processor for the publication of judgments and decisions on Find Case Law. The court that decided the case is the data controller for the content of judgments. In doing so, both parties are acting in a judicial capacity.

Publication of personal data

Court judgments and tribunal decisions contain information about people. This typically includes the names of parties and other people mentioned in the case, as well as their representatives and the names of the judges hearing the case. The information about people varies and can be very extensive. It can include a variety of types of special category personal data, depending on the subject matter of the case.

We must comply with reporting restrictions in law. A court or tribunal may decide to redact personal data within a judgment, such as an individual’s name or address. The court may also hold its proceedings in private and place restrictions on access to court and tribunal files. Such decisions are judicial decisions and can only be taken within the context of legal proceedings. Individuals wishing to request anonymisation or withdrawal of a judgment from publication should seek legal advice.

The National Archives cannot and will not take down a judgment published in Find Case Law without explicit instruction from the court or tribunal. Revisions to judgments already published must also come directly from the court or tribunal. See also our publishing policy.

Court judgments are largely exempt from the requirements of data protection law. The Information Commissioner has no regulatory function in relation to an individual acting in a judicial capacity, or a court or tribunal acting in its judicial capacity.
