NCN: [2024] UKFTT 00887 (GRC)

Case Reference: FT/PEN/2024/0160

First-tier Tribunal
(General Regulatory Chamber)

Pensions

Heard at: Decided without a hearing.

Decision given on: 07 October 2024

Before

DISTRICT JUDGE WATKIN

Between

LIFELINKED LTD

Appellant

and

THE PENSION REGULATOR

Respondent

DECISION

1.

The Appeal is withdrawn with the permission of the Tribunal.

2.

As this decision has been made in the absence of the parties, the parties are permitted to apply, in Form GRC5 (for the attention of District Judge Watkin), for the Tribunal to reconsider this decision. Any such application must be made by 5pm on 29 October 2024.

REASONS

1.

By email dated 1 October 2024, the Appellant has requested to cancel the Tribunal.

2.

The Appellant has stated that his reasons for withdrawing are that it cannot afford to pay for a lawyer.

3.

Whilst there is no requirement for any party to be represented by a lawyer, if the Appellant had wished to proceed without a lawyer, and there had been any doubt as to whether this was a possibility, enquiries could have been made in that regard. No such enquiries have been received.

4.

The final hearing is listed for 8 October 2024 and the Appellant is at liberty to apply under paragraph 2 of the decision as set out above and rules 17(3).

Signed: District Judge Watkin
