Decision: The appeal is withdrawn with the consent of the Tribunal.

REASONS

1.

This appeal was listed for hearing, by CVP, (along with a linked appeal – Ref. CA-2023-0007) on Wednesday, 20 December 2023 and Thursday, 21 December 2023.

2.

By email of today, Tuesday, 19 December 2023, the Appellant in writing, gave notice to the Tribunal of his wish to withdraw his appeal, stating that he did not wish to be a trustee of, or have any involvement in, the charity in question in this appeal, MuffinPug Rescue, or any charity, stating further that his initial reasoning for lodging his appeal, was not to be reinstated as trustee but to ‘correct information put forward by the [Respondent] and current trustees’. (The Tribunal noted that this assertion was, essentially, contrary to the contents of the Appellant’s filed Notice of Appeal).

The Tribunal hereby consents to the Appellant’s withdrawal of his appeal, pursuant to Rule 17 of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, there being no objection from the Respondent.

4.

The Appellant is advised that he may apply to the Tribunal, in writing, within 28 days of the date of this Decision, to reinstate his appeal, whereupon such application will be considered by the Tribunal and a decision made thereon.

5.

Each party is hereby notified that the withdrawal of this appeal has taken effect.
