Decision: The appeal is allowed. The decision dated 12 October 2021 suspending the Appellant’s Certificate of Competence pursuant to Regulation 19 of the Welfare of Animals at The Time of Killing (England) Regulations 2015, is overturned.

REASONS

The Respondent no longer contests the appeal and it is fair and just to allow the appeal in these circumstances.

DIRECTIONS

1.

The Appellant is to lodge any application for costs, if so advised, with 14 days of the issue of this Decision pursuant to Rule 10 of the Tribunal Procedure (First-tier Tribunal)(GRC) Rules 2019, as amended.

2.

The Respondent is to lodge a submission in response to the application within 14 days of receipt of the application.

3.

On receipt of the above the application to be listed before Judge Findlay for determination on the papers.
