JUDGMENT

1. LORD JUSTICE WARD: This is a most unfortunate situation and the court wishes to apologise particularly to the appellants, Mr and Mrs Gezer and their family, who have been waiting a long time for a decision. I hope that apology can be conveyed. I am sure Mr Rabinder Singh will explain more fully why the court has concluded that in the interests of his client we should adjourn, so he may have a chance to look at my Lords' judgment in the other case and deal with it accordingly.

2. All I can promise to do, if that can be conveyed, is to ask the listing office to list this as soon after judgment is handed down as is reasonable, which I hope will be ready early in the term, and I hope we can re-fix this according to convenience. I think it should be reserved to Lord Justice Laws.

Order: Appeal adjourned
