![]() | In the First-tier Tribunal (General Regulatory Chamber) Pensions |
Before: Judge Mornington
Appellant: Fox and Hounds Caversham
Respondent(s): The Pensions Regulator
Determined on the papers
Decision:
1. The Appeal is struck out.
REASONS
On 21 May 2026, the Appellant filed a GRC1 to appeal against a fine imposed by the Respondent.
On 26 May 2026, the Tribunal issued directions to the Appellant as the Tribunal determined that the Appellant’s appeal notice as incomplete. The Tribunal set out exactly what was required of the Appellant and confirmed that should the Appellant fail to comply with the directions in supplying everything which had been requested, that this could lead to the appeal being struck out.
The Appellant has not responded to the Tribunal’s directions of 26 May 2026.
Under Rule 8(3), the Tribunal may strike out a case where:
the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them;
the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly;
In this case, the tests under Rule 8(3) (a) and (b) are met and the appeal is therefore struck out.
Signed: Judge Mornington
Date: 26 June 2026
