Decision: The appeal is struck out under rule 8(1) of The Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 for non-compliance with a Tribunal Direction.
REASONS
The Appellant lodged an appeal using the GRC1 form on 10 March 2026. The appeal was incomplete as the Appellant did not provide a copy of the Decision Notice issued by the Respondent on 26 February 2026.
By Directions and email dated 13 March 2026, the Appellant was required to provide the full Decision Notice and return it within 14 days.
By Directions and email dated 30 April 2026 the Appellant was required to provide the full Decision Notice by no later than 14 May 2026.
The Directions dated 30 April 2026 stated:
“The Appellant is asked to note that failure to comply with the direction above could lead to the Tribunal striking out this appeal for failure to comply pursuant to Rule 8(3)(a) of The Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 without further direction.”
By Directions dated 29 May 2026 the Appellant was directed to provide the Full Decision Notice by 15 June 2026.
The Directions dated 29 May 2026 stated:
“Rizvana Saddique is hereby notified that a failure to comply with the directions here may result in the striking out of the proceedings pursuant to rule 8(1) without further direction.”
The Appellant failed to comply with the Direction dated 29 May 2026 and accordingly there are grounds to strike out the appeal.
