REASONS
By directions sent on 28 December 2025 the Appellant was informed that the notice of this appeal was incomplete, and directed that further documents must be provided in order for the appeal to proceed.
No further documents have been submitted pursuant to those directions.
By directions dated 23 April 2026 the Tribunal informed the Appellant that it was considering striking out this appeal on the ground that it had no reasonable prospect of success, following a submission from the Respondent that the Appellant had failed a third attempt at the Part 3 (instructional ability) test, and invited any submissions from the Appellant in relation to this by 7 May 2026.
The Appellant did not respond to those directions.
In each case these directions warned the Appellant that failure to comply could result in the appeal being struck out under rule 8(3)(c) of the Tribunal Rules.
The Appellant having failed to provide a complete appeal form, the Tribunal is unable properly to consider the appeal. The Appellant having passed his Part 1 test more than two years ago, I find that this appeal has no reasonable prospect of success and accordingly it is appropriate that it is struck out pursuing to rule 8(3)(c).
Accordingly, the appeal is struck out.
