DECISION

1.

The Appeal is struck out.

REASONS

1.

The Respondent has applied to have the case struck out under Rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009) on the basis that the appeal has no reasonable prospect of success.

2.

The Respondent has stated that the appeal has no prospect of success because the part 1 test has expired, meaning that the Appellant may not, now, re-book the part 3 test.

3.

Directions were sent to the Appellant on 14th April 2026. The directions warned that the Tribunal was considering striking out the appeal and required a response by 28th April 2026.

4.

No response has been received from the Appellant. I am satisfied that the Appellant has had the opportunity to respond, as is required by Rule 8(4).

5.

Under Rule 8(3)(c), the Tribunal may strike out a case where the Tribunal considers there is no reasonable prospect of the Appellant's case, or part of it, succeeding.

6.

The test under Rule 8(3)(c) is met and the appeal is therefore struck out.

7.

In making this decision I have considered the overriding objective and exercised my discretion under Rule 8(3).
