MALCOLM SIMMONS

Applicant

and

THE INFORMATION COMMISSIONER

Respondent

Decision: The appeal is struck out under rule 8(1) for non-compliance with a Tribunal direction.

REASONS

1.

The Applicant has made four applications for an order to progress a complaint made to the Information Commissioner (“IC”) dated 30 August 2024 which were allocated the four case numbers set out above. The Information Commissioner has submitted a response to each application.

2.

By Directions dated 5 February 2026 the parties were required to provide dates to avoid for a case management hearing to the Tribunal by 13 February 2026. A reasonable adjustment was made to enable the Applicant to do this by telephone.

3.

The parties were directed to note that failure to comply with these directions would lead to the Tribunal striking out under Rule 8(1). The Respondent complied with the directions on 13 February 2026.

4.

The Applicant failed to comply with the directions dated 5 February 2026 and accordingly all four sets of proceedings are struck out under Rule 8(1).
