Decision: The appeal is struck out under rule 8(3)(a) for non-compliance with a Tribunal direction.
REASONS
The Appellant lodged an appeal using the GRC1 form on 20 January 2025.
By Directions dated 11 November 2025 the Appellant was required to provide a copy of the hearing bundle to the Tribunal by 5 January 2026. The Appellant did not comply with that Direction and provided no explanation for this.
In the same Directions, the Appellant was directed to attend or be represented at a Case Compliance Hearing on 13 January 2026 at 10am.
The Appellant was directed that if they failed to attend or be represented at the Case Compliance Hearing this could lead to the Tribunal striking out the appeal and summarily determining all issues against the Appellant.
The Appellant failed to attend. The clerk attempted to contact the Appellant by telephone on the morning of the hearing without success. The Case Compliance Hearing was attended by both Respondents and it appeared to me to be in the interests of justice to proceed with the hearing in the Appellant’s absence because no explanation had been given for non-attendance.
The Appellant failed to comply with the Direction dated 11 November 2025 in that it failed to file a bundle with the Tribunal and failed to attend the Case Compliance hearing without explanation. Accordingly, there are grounds to strike out the appeal.
