REASONS
A hearing of this appeal was listed for 16 February 2026.
On 11 February 2026, the Respondent informed of the Tribunal that the Appellant had failed his third attempt at the Part 3 (instructional ability) test, and applied to the Tribunal strike out the appeal on the ground that it therefore had no reasonable prospect of success.
By email dated 12 February 2026 the Tribunal informed invited any submissions from the Appellant in relation to this, noted that the hearing was listed for 16 February 2026, and that the Appellant could make representations at that hearing or in writing in advance.
By email dated 15 February 2026, the Appellant consented to the proposed striking out. The Appellant did not attend the hearing listed for 16 February 2026.
The Appellant having failed his Part 3 test, I find that this appeal has no reasonable prospect of success and accordingly it is appropriate that it is struck out pursuing to rule 8(3)(c).
It is not necessary to go on to consider the merits of the appeal.
