Decision: The appeal is struck out under rule 8(3)(a) for non-compliance with a Tribunal direction.

REASONS

1.

The Appellant lodged an appeal using the GRC1 form on 4 August 2024. The appeal was admitted out of time by a Registrar on 20 September 2024, but due to an administrative error these directions were not issued at the time or sent to the Appellant.

2.

By Directions dated 30 July 2025, the Appellant was required to confirm by 18 August 2025 whether they wish to continue with or withdraw the appeal. The Appellant did not comply with that Direction and did not respond to the Tribunal.

3.

By Directions dated 17 October 2025, the Appellant was directed by 31 October 2025 to confirm whether they wish to withdraw or continue the appeal, or make representations as to why the appeal should not be struck out.

4.

The Appellant was directed to note that failure to comply with this Direction could lead to the Tribunal striking out the appeal for failure to comply without further direction.

5.

The Appellant failed to comply with the Direction dated 17 October 2025 and accordingly there are grounds to strike out the appeal.
