Alison Sinclair v Registrar of Approved Driving Instructors

This case concerns an appeal against the Respondent’s decision to refuse the Applicants third trainee licence application.

The Applicant lodged a Notice of Appeal dated 24 December 2025 with the Tribunal.

The Respondent applied on the 15 January 2026 for the case to be struck out. The strike out application was made on the basis that the Applicant’s application has no prospect of success under Rule 8(3)(c) of the relevant Tribunal Rules.

Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005 provides that where an individual has failed the instructional ability test three times the licence ceases to remain in force.

The Applicant failed their third attempt at the instructional ability test on 14 January 2026 (a fact acknowledged by the Applicant in correspondence between the parties on the 27 January 2026). The Applicant has made no submissions to challenge the strike out application.

In light of the above there is no reasonable prospect of the Applicant being able to successfully argue that the Tribunal has the power to grant a further period of trainee licence. . It is therefore ordered that this case is struck out under Rule 8(3)(c).
