Decision: The appeal is struck out under Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal)(General Regulatory Chamber) Rules 2009 (the “Rules”)

REASONS

1.

The Appellant sought to appeal by way of form GRC1 (Notice of Appeal) apparently dated 14 October 2024. Having been sent to the wrong email address by the Appellant, it was forwarded to the Tribunal by the Respondent on 17 October 2024. The copy sent appeared to be incomplete, as there were several pages which the Tribunal was unable to view.

The Tribunal wrote to the Appellant on 4 November 2024 acknowledging receipt, but stating that there was no copy of the written decision which he was seeking to appeal and giving 28 days to submit a complete appeal. No response was received from the Appellant.

The Tribunal emailed the Appellant again on 10 February 2025, asking him to resend the completed form GRC1 and Notice of Decision. No response was received from the Appellant.

By case management direction (the “Direction”) dated 4 July 2025, the Registrar ordered that the Appellant was to submit these documents by no later than 18 July 2025. The Direction also notified the Appellant that failure to comply may result in the appeal being struck out for non-compliance without further direction pursuant to Rule 8(3)(a).

The Appellant has failed to comply with the Direction and there are grounds to strike out the appeal because the Appellant failed to comply with a direction that stated that failure to comply with the direction could lead to the striking out of the appeal.

Accordingly, the appeal is struck out for non-compliance under Rule 8(3)(a).

The Appellant may apply for the appeal to be reinstated under Rules 8(5) and (6) of the Rules. The application must be in writing and be received by the Tribunal within 28 days after the date on which this Decision is issued.
