Decision: The appeal is treated as withdrawn, pursuant to Rule 17(1)(6) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, as amended, in circumstances where the Respondent had provided notification to the Tribunal, noting also to the Appellant, that the Appellant had passed her instructional ability test (‘the Part 3 test’) and that, therefore, her appeal, listed for hearing by CVP on 7 November 2025, was now obsolete, and inviting the Appellant withdraw her appeal, an invitation to which the Appellant did not respond.
REASONS
This appeal, against a decision of the Respondent dated 9 May 2025 to refuse the Appellant’s application for a third Trainee Licence, came before me pursuant to a First Legal Review.
This appeal was listed for hearing on 7 November 2025, by CVP, at 10.00.
The Respondent wrote to the Appellant on 24 July 2025, copied to the Tribunal, inviting the Appellant to withdraw her appeal since she had now passed her instructional ability test (‘the Part 3 test’), making her appeal obsolete. The Appellant had not, by today, replied to that invitation.
For the reason stated in the Decision, this appeal is now treated as withdrawn.
No application was outstanding from either party.
Having considered the matter, and having regard to the overriding objective, that requires the Tribunal to deal with cases fairly and justly, I treat this appeal as withdrawn and the date fixed for hearing vacated.
