REASONS
This matter was listed for an appeal against the decision of the Registrar of Approved Driving Instructors, dated 25th November 2024, refusing the Appellant’s application for a third trainee licence. Neither party to this appeal attended the hearing today, having been notified of the date at an earlier stage in the proceedings. However, for the reasons set out below, I do not take issue with this, as there is good reason for this lack of attendance.
On 25th June 2025, the Appellant emailed the Tribunal to advise that he had now passed his Part 3 test and therefore no longer required a trainee licence. He stated that he now wished to withdraw his appeal.
On 26th June 2025, the Respondent copied in the Tribunal to an email which was sent to the Appellant, congratulating him on his successful completion of the Part 3 test, and communicating that a refund of the fee paid for the trainee licence application would be refunded to him and that he would be placed on the Register of Approved Driving Instructors.
It is clear from this correspondence that both parties have consented to the withdrawal of the proceedings, but in any event, a hearing has now been held for the purposes of Rule 32(1) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, and I therefore consent to the withdrawal under Rule 17(3).
The appeal is withdrawn.
