Decision: The appeal is struck out pursuant to Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 (‘the Rules’).

REASONS

1.

This appeal is struck out, pursuant to Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 (‘the Rules’) as having no reasonable prospects of success, as the Appellant, on 1 May 2025, failed his maximum third attempt at passing the Part 3 test to become a qualified Approved Driving Instructor.

Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005 provides that a trainee licence remains in force until the day immediately following a trainee’s third unsuccessful attempt to pass the said Part 3 test.

On 2 May 2025, the Respondent made application to have this appeal struck out in the said circumstances. I grant the Respondent’s application in all the circumstances without further direction.

I have considered the matter and have had regard to the overriding objective that requires the Tribunal to deal with appeals fairly and justly.

This appeal is struck out pursuant to Rule 8(3)(a) of the Rules.
