Jyotika Verma v The Registrar of Approved Driving Instructors

Neutral Citation Number[2025] UKFTT 616 (GRC)

Neutral citation number: [2025] UKFTT 00616 (GRC)

Case Reference: FT.D.2024.0991

First-tier Tribunal
(General Regulatory Chamber)

TRANSPORT

Decided without a hearing

Decision given on: 3 June 2025

Before

HHJ David Dixon

Between

JYOTIKA VERMA

Appellant

and

THE REGISTRAR OF APPROVED DRIVING INSTRUCTORS

Respondent

Decision: The appeal is struck out.

REASONS

1.

On 1st November 2024 the Tribunal received an appeal on form GRC1, which was incomplete as it did not include a copy of appeal decision form, nor was it signed to say the details were true. The Appellant was informed of the same, but failed to provide further details.

2.

As a result of the lack of a decision letter, and an appropriately signed form being supplied, Case Management Directions, were supplied on 23rd January 2025 requiring a signed form, and a copy of the decision letter; all of the same to be supplied by 6th February 2025, with a warning that the case would be struck out if there was non-compliance.

3.

No reply was received to the Directions.

4.

By virtue of paragraph 8(3) of The Tribunal Procedure (First Tier Tribunal)(General Regulatory Chamber) Rules 2009, the Tribunal may strike out a party’s case, in whole or in part, where:

a.

the appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them;

b.

the appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly; or

c.

the Tribunal considers there is no reasonable prospect of the appellant's case, or part of it, succeeding.

5.

Here the Appellant has failed to co-operate with the proceedings, has failed to provide a decision to be appealed and therefore it is impossible for the case to proceed. The failure to assist with the proceedings leaves the Tribunal with no option.

6.

The Appeal is struck out with immediate effect.
