It is ordered:-

1. The Appeal is struck out.

REASONS

On 5 October 2024, the Appellant filed a GRC1 seeking to challenge a decision of the Respondent. This was incomplete because it was not clear whether the appellant has a right of appeal.

On 28 November 2024, the Tribunal gave a Case Management Direction to for the Appellant to provide the “Pensions - right to appeal” form to the Tribunal within 28 days.

On 24 January 2025, the Tribunal issued a further Case Management Direction to the Appellant for him to provide a copy of the form by no later than 7 February 2025. The Appellant was warned that failure to comply with this direction could lead to the Tribunal striking out the appeal.

Under Rule 8(3), the Tribunal may strike out a case where:

(a)

the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them; or

(b)

the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly.

Both circumstances are met in this case.
