Decision: The appeal is struck out under Rule 8(3)(a)

REASONS

1.

The Tribunal received the Appellant’s incomplete appeal notice on 17th June 2024. Although the correct GRC1 form had been used to lodge the appeal, page 7 of the form was missing, and the Appellant failed to provide a copy of the decision which they wished to challenge.

The Tribunal wrote to the Appellant by email on 1st August 2024, requesting the missing items, and on 11th December 2024, Case Management Directions were sent to him directing as follows:

“The Appellant must provide a copy of page 7 of the GRC1 form and the decision they seek to challenge to the Tribunal by no later than 30 December 2024.”

The Case Management Directions notified the Appellant that a failure to comply with the above direction could lead to the Tribunal striking out his appeal under Rule 8(3)(a).

Having considered this matter, and having regard to the overriding objective, which requires the Tribunal to deal with cases fairly and justly, I can see no reason why striking out the appeal would be unfair or unjust.

The appeal is struck out under Rule 8(3)(a).
