Decision:

1. The Appeal is struck out.

REASONS

On 25 February 2025, the Appellant filed a GRC1 seeking to challenge a decision of the Respondent. This was incomplete because it did not include evidence to show that the Appellant had the right of appeal.

On 27 February 2025, the Tribunal gave a Case Management Direction for the Appellant to provide a provide a copy of the “Pensions - right to appeal” form to the Tribunal within 28 days.

On 10 September 2025, the Tribunal issued a further Case Management Direction to the Appellant to provide a copy of the "Pensions - right to appeal” form by no later than 24 September 2025. The Appellant was warned that failure to comply with this direction could lead to the Tribunal striking out the appeal.

The Tribunal has not received the “Pensions - right of appeal” form from the Appellant and it remains unclear whether the Appellant has the right of appeal.

Under Rule 8(3), the Tribunal may strike out a case where

(a)

the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them; or

(b)

the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly.

Both circumstances are met in this case and the appeal is therefore struck out.
