Decision: The proceedings are struck out under Rule 8(3)(a) of The Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 for non-compliance with a Tribunal direction which stated that failure to comply could lead to the striking out of the proceedings.

REASONS

The Appellant lodged an appeal on 8 May 2025 against a decision of the Respondent to refuse their application for a third trainee licence. The appeal was incomplete because the Appellant did not include a copy of the decision they seek to challenge, and the appeal form was not fully completed. In particular, the Appellant failed to specify the outcome being sought and the statement of truth was also undated.

Rule 22(2)(f) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 requires that a notice of appeal must specify the result the appellant is seeking. At Rule 22(3), if the proceedings challenge a decision, the appellant must provide with their notice of appeal a copy of any written record of that decision.

By Case Management Directions dated 9 May 2025 the Appellant was required to provide the missing information to the Tribunal within 28 days. When no response was received, the Tribunal extended the period for compliance until 21 July 2025 in further Directions dated 4 July 2025. Those Directions contained a clearing warning that a failure to comply could lead to the striking out of the proceedings without further notification. The Appellant has not responded.

Under Rule 8(3)(a) of the 2009 Rules, the Tribunal may strike out the proceedings if “the appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them”.

As the Appellant has not provided a copy of the decision being appeal against or the information missing from their appeal form, there is non-compliance with the Tribunal’s Directions warranting the striking out of the appeal.
