REASONS

This appeal was listed for determination remotely, by CVP, today to commence at 10.00. However, there was no appearance by, or on behalf of, either party at that time. At the request of the Tribunal, the clerk contacted the Respondent by email to seek clarification on whether the Appellant had undertaken his final permitted attempt at a Part 3 test on 22 September 2025 and, if so, the outcome of that test. No reply was received from the Respondent. At the further request of the Tribunal, the clerk contacted the Appellant who advised that he had received an email from GRC that this appeal had been cancelled. This was not something advised to the Tribunal. Nevertheless, on being sent the joining link, the Appellant joined the hearing at 10.20. He confirmed that he had been sent the said email on 23 September 2025 and that he had undertaken his third, and final permitted, attempt to pass his Pat 3 test on 2 September 2025, but had not been successful.

The Tribunal advised the Appellant that, in those circumstances, this appeal had to be dismissed; indeed, it had to be dismissed whether or not he had succeeded in passing his final permitted attempt to pass his Part 3 test in circumstances where he had undertaken his third Part 3 test.

The Appellant confirmed he had nothing further to add, the Appellant was thanked for his attendance and the hearing was concluded.

Accordingly, the appeal is dismissed.
