Decision:

1. The Appeal is struck out.

REASONS

On 4 March 2025, the Appellant filed a GRC1 seeking to challenge a decision of the Respondent.

On 19 June 2025, the Tribunal gave a Case Management Direction directing the Appellant to state what provision under the Pensions Act 2008 it considers gives this Tribunal the power to consider a ‘Letter Before Legal Action’ and reasons why the Tribunal should not strike out the matter for want of power to consider this matter pursuant to Rule 8(2)(a) by no later than 4 July 2025.

The Appellant was warned that the striking out of the appeal would be considered whether the Appellant complied with the directions or not.

The Appellant has not responded to the Tribunal and has not complied with these directions.

Under Rule 8(3), the Tribunal may strike out a case where:

(a)

the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them; or

(b)

the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly.

Both circumstances are met in this case.
