Case No. FT/D/2024/1087 | |
![]() | In the First-tier Tribunal (General Regulatory Chamber) Pensions |
Before: Judge Mornington
Appellant: Texder Jade Wayne Holl
Respondent(s): The Registrar of Approved Driving Instructors
Determined on the papers
Decision:
1. The Appeal is struck out.
REASONS
On 4 November 2024, the Appellant filed a GRC1 seeking to challenge a decision of the Respondent. This was incomplete because it did not include a dated copy of the decision they sought to challenge.
On 24 December 2024, the Tribunal gave a Case Management Direction to provide a dated copy of the decision that the Appellant sought to challenge within 28 days.
On 7 March 2025, the Tribunal issued a further Case Management Direction to the Appellant for him to provide a copy of the dated decision they seek to challenge by no later than 21 March 2025. The Appellant was warned that failure to comply with this direction could lead to the Tribunal striking out the appeal.
Rule 22(3) requires the Appellant to provide a copy of any written record of the decision they seek to challenge by way of their appeal.
Under Rule 8(3), the Tribunal may strike out a case where
the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them; or
the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly.
Both circumstances are met in this case.
Signed: Judge Mornington
Date: 30 September 2025
