Ruling on Respondent’s application to strike out the appeal

It is ordered that:-

1. The Appellant’s appeal is struck out.

2. No further action is required by any of the parties.

REASONS

By an undated and incomplete Notice of Appeal, the Appellant appealed the Respondent’s decision dated 31 August 2023 not to grant him a third trainee licence under s.129 of the Road Traffic Act 2024. The Appellant claimed that the decision did not take appropriate account of factors that had directly and adversely impacted his training to become an Approved Driving Instructor. Pending the hearing of his appeal, however, the Appellant booked a Part 3 test for the third time which he failed on 10 November 2023. Consequently, his trainee licence was revoked.

On 23 January 2024, the Tribunal notified the Appellant that the Respondent had applied to strike out the appeal, but the Appellant did not reply by the specified dated of 6 February 2024 or at all.
